TestTalon commercial purchases are currently disabled and no commercial source code is delivered through the website. This policy is written for possible future sales and must be reviewed against applicable consumer law and the selected payment and delivery providers' rules before any purchase is enabled. 1. What would be sold TestTalon Commercial editions are digital source-code licenses, not transfers of copyright ownership. When a paid order is accepted and fulfilled, the customer receives access to the source code under the applicable Commercial Source Code License, together with the support and update benefits stated in that license and the accepted order. Because source code can be copied once it has been accessed, refund conditions depend in part on whether the commercial source code has been accessed. This policy does not limit mandatory rights that apply in your jurisdiction. 2. Cancellation before source-code access You may request a voluntary cancellation and refund if both of the following are true: - the request is made within 14 calendar days after the payment provider confirms successful payment for the order; and - you have not accessed the commercial source code. "Source-code access" means the first successful download, clone, or retrieval of the commercial source code using an authorized delivery mechanism. An order confirmation, or a delivery link that has not been used, is not by itself source-code access. To request cancellation, follow Section 5. We will assess whether access has occurred using the order and delivery records available to us and the information you provide. This 14-day pre-access window is a voluntary TestTalon policy and is not a statement of statutory rights. Where the law gives you additional cancellation or withdrawal rights, those rights apply regardless of this window. 3. After source-code access Once the commercial source code has been accessed, purchases are generally final and not eligible for a voluntary change-of-mind refund, to the extent permitted by applicable law. This is because source code that has been accessed cannot reliably be returned or made unreadable. We will nevertheless provide a refund or other remedy where applicable law requires it, including for non-delivery, material nonconformity with the agreed description, or other legally protected circumstances. Statutory rights and remedies that cannot be waived are not affected by this policy. Where the law requires express consent to immediate digital delivery, or acknowledgement of its consequences for withdrawal rights, that consent or acknowledgement must be obtained separately at checkout. This policy alone is not that consent. 4. Situations we will review We will review requests involving: - Duplicate payments: refund of the verified duplicate charge. - Failed delivery: help completing delivery, or a refund if delivery cannot be completed or the law requires one. - Material nonconformity or defects: reasonable assistance, a conforming correction or update, and a refund or other remedy where the law requires it or we agree. - Unauthorized transactions: investigation together with the payment provider under its rules. - Statutory remedies: any remedy required by applicable consumer-protection or digital-content law. A request is not rejected solely because a download was recorded. We consider the actual facts and the rights that apply. 5. How to request a refund or cancellation Email support@testtalon.com with your order number, purchase email address, edition, purchase date, a description of the issue, and any relevant evidence. Please do not send passwords, full payment-card numbers, or confidential customer data. We may ask for reasonable additional information needed to review the request. We will respond as soon as reasonably practicable. Approved refunds are returned through the original payment method where the provider supports it. The payment provider and your bank determine when funds appear. Taxes, fees, and currency conversion follow applicable law and the provider's rules. 6. Effect of a refund on license rights and access An approved refund or payment reversal does not transfer ownership of TestTalon or its source code to the customer. Software-license termination and any post-termination duties are governed by the applicable Commercial Source Code License, the accepted order terms, and mandatory law. The Commercial Source Code License does not currently contain an express clause that terminates the license upon a refund, cancellation, or payment reversal. This policy does not create one, and it does not state that a refund automatically ends all software rights. Separately from the license, TestTalon controls its own delivery, update, and support channels. After a full refund of an order, we do not intend to provide further downloads, updates, or support for that order. We cannot remotely delete or technically disable source-code copies that have already been received, and we do not guarantee that continued use or copying can be technically prevented. 7. Payment providers, disputes, and chargebacks If checkout is enabled in the future, transactions may be processed by a third-party payment or delivery provider. The provider's refund, dispute, and chargeback rules may apply, and nothing in this policy overrides mandatory law or a provider's obligations. A provider may decide a dispute or chargeback independently. We encourage you to contact support@testtalon.com before starting a payment dispute so that we can try to resolve the issue directly. While a payment dispute is open, we may pause downloads, updates, and support for the affected order. 8. Community Edition The free Community Edition has no purchase price to refund. Its usage rights are governed by the Community Source Code License. 9. Changes and contact We may revise this policy for future transactions. The version in force when an order is accepted, together with mandatory law and the accepted order terms, governs that order. Changes will not retroactively remove rights without a lawful basis.
